Why it matters

The decision highlights the importance of upholding the requirement for a solid evidentiary basis in detention proceedings, even when dealing with serious violent crimes and suspects classified as heads of criminal organizations.

Key points

  • ▪The Magistrate's Court denied the police request to extend Yossi Musli's detention by 11 days.
  • ▪The police appealed to the District Court, which upheld the release decision and rejected the appeal.
  • ▪The judges ruled that there was no significant strengthening of the evidentiary basis linking Musli to the assault.
  • ▪The defense argued that Musli's version was not contradicted and that it was a spontaneous event.
  • ▪The court clarified that the police may request a new detention if there is a development in the investigation.

The detention case of Yossi Musli, suspected of involvement in a serious assault and battery, reached a turning point following hearings at the Tel Aviv Magistrate's Court and an appeal to the District Court. Musli was arrested on August 16 on suspicion of conspiracy to commit a crime and assault causing actual bodily harm. The police, represented by Sgt. Maj. Adv. Bat-El Aloni, requested to extend his detention by 11 days, arguing that significant progress had been made in the investigation and that the suspicion against him had strengthened. The police emphasized that this was a serious attack committed jointly with other suspects who have yet to be located, and that there is a risk of obstruction of justice.

Conversely, Musli's defense attorney, Adv. Sperling, argued that the police failed to present new evidence establishing the suspicion, noting that Musli has provided a consistent version of events from the outset, including the claim that he attempted to assist the victim. Judge Shani Stern of the Magistrate's Court examined the new investigation materials presented to her and determined that they did not constitute a significant development in the investigation. The judge emphasized that a suspect's mere presence at a scene does not necessarily link them to the commission of the offense itself. Consequently, the judge ordered Musli's release to full house arrest at his home in Savyon, under restrictive conditions and financial guarantees.

The police appealed this decision to the Tel Aviv District Court. Judge Noa Tabor, who heard the appeal, stated that she shared the assessment of the Magistrate's Court. Judge Tabor noted in her decision that despite the vigorous actions taken by the investigating unit, the evidentiary basis regarding Musli's role as a joint perpetrator had not been significantly strengthened. However, the judge clarified that this decision does not prevent the police from requesting a new detention order should additional evidentiary developments arise in the ongoing investigation. As of now, Musli has been released to house arrest, while the police investigation into his case and the search for other suspects who fled remain ongoing.
