In an exceptional case, an Israeli court has sentenced a 32-year-old survivor of the Nova music festival massacre to nine months of community service. The defendant was convicted of possessing a wide array of drugs in quantities described by the prosecution as a 'drug store. ' The prosecution, noting the seizure of over four and a half kilograms of solid drugs and tablets, along with three liters of liquid substances, had sought a five-year prison sentence.

The court, however, recognized the severe post-traumatic stress disorder (PTSD) the defendant experienced following the events, ruling that it significantly impaired his ability to exercise balanced judgment. Although the judge acknowledged that the quantity and variety of drugs suggested deep involvement in the drug trade and high potential for public harm, he decided to deviate from the standard sentencing range of four to seven years. Evidence showed that the defendant’s home and vehicle contained large quantities of cocaine, MDMA, ketamine, and LSD.

The defendant pleaded guilty to the indictment and was convicted of possession of drugs not for personal use. The prosecution highlighted the defendant's prior criminal record for drug offenses, which included a ten-month prison sentence for drug trafficking. They argued that he had struggled to take full responsibility and that his ongoing rehabilitation did not warrant avoiding incarceration. Conversely, the court took into account the defendant's long and successful rehabilitation process, including day treatment, full cooperation, and clean urine tests, with the exception of prescribed medical cannabis.

The judge stated that the defendant should be allowed to continue his positive trajectory, while warning that any violation of the terms or illegal drug use could lead to the termination of community service and imprisonment for the remainder of the sentence. In addition to community service, he received a fine, a suspended driver's license, and a one-year probation order. The court also officially declared him a 'drug trafficker. '
