Why it matters

The lawsuit highlights the importance of informed consent in aesthetic medicine. It raises significant legal questions regarding a surgeon's authority to alter a surgical plan while a patient is anesthetized, and the obligation to immediately report and update the patient on such changes.

Key points

  • ▪Medical malpractice claim alleging unauthorized alteration of a surgical plan during anesthesia.
  • ▪Plaintiff claims she paid for a full tummy tuck but underwent only a partial procedure.
  • ▪Medical opinions assessed a combined disability of approximately 43.3% as a result of the surgical proceedings.
  • ▪Plaintiff claims previously identified medical issues were not addressed during the surgery.
  • ▪Clalit Aesthetic stated they offered resolution alternatives and the matter will be litigated in court.

A Gaza Envelope resident in her 40s has filed a medical malpractice lawsuit against S. L. H. Medical Services (operator of 'Clalit Aesthetic'), Clalit Health Services, and the operating surgeon. According to the lawsuit filed at the Tel Aviv Magistrate's Court by Adv. Ran Shapira, the plaintiff signed a consent form for a full tummy tuck, but alleges that during the surgery, the procedure was altered while she was under anesthesia without obtaining further authorization.

The complaint states that after waking up, the plaintiff was not informed that the surgical plan had been changed and that a full tummy tuck, as agreed, had not been performed. Only after suspecting that the results did not meet expectations and seeking external medical advice did she discover that only a partial procedure had been carried out. In a later visit summary, the surgeon claimed he decided against an incision around the navel because he found insufficient excess skin.

A medical opinion by Dr. Or Friedman, attached to the claim, stated that the umbilical hernia and abdominal muscle separation the plaintiff suffered from remained untreated. The expert estimated her medical disability at 19% and noted that a series of complex surgeries might be required to correct the situation, at an estimated cost of up to 150,000 NIS. Concurrently, her psychiatrist, Dr. Sergio Marchevsky, estimated her psychiatric disability at 30% following an adjustment disorder.

Conversely, 'Clalit Aesthetic' stated that the network management and the chief physician offered the patient several alternatives for resolution, aiming to provide a professional and fair medical response. The network declined to detail the nature of these alternatives due to medical confidentiality and announced that the matter would be clarified in court.
