The Police Investigations Department (Mahash) recently filed an indictment at the Be'er Sheva Magistrate's Court against two National Guard members, Maman and Harliakar, charging them with assault under aggravating circumstances. According to the indictment, the incident occurred during a routine patrol in the town of Tel Sheva. Allegedly, one of the defendants approached two residents, demanding to know where they lived while using a derogatory term to describe the town. When one of the residents corrected the name of the town, a violent altercation ensued.
According to the indictment, the defendants ordered the two men to identify themselves and conducted physical searches, despite the claim by Mahash that they lacked any legal authority to do so. The indictment alleges that after the search yielded nothing, the defendants proceeded to assault the residents with severe physical force. It is described that one defendant struck a resident in the back, knocked him to the ground, and continued to strike his head and face while he was on the ground, ignoring the victim's pleas. The second defendant is charged with conducting an unauthorized search of the other resident and assaulting him with kicks to sensitive body parts, using significant force to knock him to the ground. It is noted that the indictment states that two other officers in the patrol car did not intervene. Furthermore, it is alleged that about an hour after the assault, the two defendants returned to the scene to determine if security cameras had recorded their actions.
The incident was revealed following a complaint filed with Mahash, which led to the investigation and arrest of the two. The case is being handled by Adv. Naama Lazmi of the Police Investigations Department. It is clarified that this is an indictment containing allegations that have not yet been decided in court, and the defendants are presumed innocent until proven guilty.
